The contractual terms and conditions described here are applied to each customer and / or visitor to the site and are the basis of any contract between the company Piscopo Vincenzo snc.  (here also piscopojewels.it) and the Customer.

Access and use of this Website, as well as the purchase of products, presuppose the reading, knowledge and acceptance of the following General Conditions of Sale.

The site www.piscopojewels.it always reserves the right to vary the terms and conditions of the Service at its discretion, notifying the user of such changes by means of a notice published on its website.

The Customer is required to accept the aforementioned changes without prejudice to the right to withdraw from the contract.

Art. 1 Definition of the parts

This contract is stipulated between the Customer indicated in the order form (hereinafter simply referred to as "Customer") and the company Ditta Piscopo Vincenzo snc based in Sorrento (NA)  Corso Italia, 210 / d - VAT number 02618581215

 

Art. 2 Scope of application

 

1) These General Conditions of Sale ("Conditions") govern the sale of products and services through the Site and form an integral part of each Sales Agreement ("Contract") that is concluded via the internet between:

 

the Company Piscopo Vincenzo snc - hereinafter also referred to as "The Seller and / or The Proponent" -

and any person who purchases products or services from the Site www.piscopojewels.it (The "Site") - hereinafter also referred to as "The Customer and / or the Acceptor" -

2)  Any Purchase Order for products on the Site is governed by these Conditions, without prejudice to the Seller's right to apply different and particular conditions.

 

The applicable Conditions are those in force at the time of placing an Order.

 

3) The Proponent reserves the right to modify these General Conditions of Sale at any time, without prior notice.

 

4) These Conditions do not regulate the sale of products or the provision of services by parties other than the Seller, which are present or recalled on the Site through links, banners or other links.

 

In relation to such sales or supplies of services, therefore, any form of liability of the Seller is excluded.

 

Art. 3 Object of the contract

The subject of the contract is the sale of goods online through the website www.piscopojewels.it managed by Ditta PiscopoVincenzo snc (VAT number 02618581215), as governed by civil law on electronic commerce. The description of the individual goods is contained in the illustrative sheets which are an integral part of these conditions.

 

Art. 4 Orders and prices

The Customer purchases the goods by sending the order form electronically, which will be valid as contractual acceptance in accordance with the relevant legislation; purchase orders for products sent to the company Piscopo Vincenzo snc must be completed in the mandatory fields under penalty of unacceptability.

 

By placing an Order through the Site, the Customer guarantees both to have the ability to act necessary to conclude legally binding contracts

 

Customers who place Orders through the Site accept the Terms and Conditions as follows:

 

The Seller offers its products for sale within the limits of stock available at the time of the Purchase Order. Orders may be subject to quantity limitations, minimum or maximum;

The Customer can only purchase the products present in the electronic catalog of the Site at the time the Order is placed, as described in the relevant information sheets.

The information on the products on the Site, such as technical specifications, images, dimensions or compatibility details, are not binding and may be subject to change at any time.

The technical steps for placing an Order are clearly highlighted in the sequence of pages of the Site, through explanatory texts and graphics.

 

By clicking on "Confirm Order", the Customer will formulate to the Piscopo snc company a contractual purchase proposal concerning the items contained in the "Shopping Cart".

 

Receipt of the Order does not constitute acceptance of the contractual purchase proposal.

 

To complete the Order, the price of the product (s) purchased by the Customer, including shipping and delivery costs, must be paid to the Seller.

 

Following the receipt of an Order, the Seller will check the availability of the products ordered and, only after this verification, will it communicate its acceptance of the Order.

 

The Contract is concluded with the receipt by the Customer of the acceptance of the Order in the form of a Receipt sent by the Company Piscopo Vincenzo snc, or, in the absence of such acceptance, with the delivery of the items covered by the Order.

 

Once the Order acceptance receipt has been forwarded to the Customer, it will no longer be possible to modify or cancel the Order, without prejudice to the right of withdrawal under the terms and conditions specified below in art. 8 of these general conditions.

 

In any case, the Seller reserves the right, at its sole discretion, to refuse an Order, to set purchase limits and to require advance payment.

 

Any form of liability, contractual or extra-contractual, deriving from the non-acceptance of an Order is excluded.

 

The Seller will have the right not to process the Purchase Orders made in accordance with the provisions of the previous provisions, in the event that the Customer has not paid for the products; or in the event that the Customer's data are incomplete and / or incorrect; or even in the event that the products ordered are not, even temporarily, available.

 

If the Seller does not execute a Purchase Order made by the Customer, the Seller will promptly inform the Customer of the foregoing and will refund any amount already paid by the Customer.

 

 

Product prices include VAT and are indicated in the illustrative sheets and in the order form in € (Euro currency); shipping and delivery costs are also indicated. The order form allows the user to clearly and unequivocally identify the VAT percentage applicable to the prices for the purchase of products and the shipping and delivery costs applied by the courier; these amounts are charged to the customer.

The payment of the price of the purchased goods can take place  by credit or debit card via PayPal, by bank transfer or by cash on delivery (only for Italy) as expressly indicated on the website www.piscopojewels.it.  

 

Art. 5 Shipping and delivery

The shipment of the purchased goods will respect the order in which the confirmed and paid orders will be received.

Shipment and delivery, to the address indicated by the Customer in the order form, will take place by express courier in Italy and in the countries indicated on the website www.piscopojewels.it.

The courier will respect, in delivering the purchased goods to the Customer, standard times and, in any case, not exceeding 3/4 working days in Italy and 7/10 working days in the European Community states starting from the receipt of the order or, in case of payment by bank transfer, from receipt of the same. For deliveries outside the European Community, the timing may vary from country to country.

 

The Seller assumes no responsibility for disservices attributable to force majeure or unforeseeable circumstances, even if dependent on malfunctions and disservices of the internet, in the event that he is unable to execute the Order within the times provided for in the Contract.

 

If the purchased products are to be delivered outside the national territory, the Customer is responsible for paying any import charges and taxes, as well as any duties and customs duties provided for by the legislation in force in the territory of destination of the products.

 

The courier is responsible for the delivery. The Seller undertakes to collect any reports of non-delivery or delayed delivery of the products.

 

Any damage to the packaging and / or products must be immediately reported to the courier through specific indication on the delivery document.

 

By signing the delivery document and in the absence of the aforementioned disputes, the Customer certifies the real material integrity of the products and the conformity of the delivery.

 

 

Art. 6 Personal data

The provision of personal data by the Customer is optional, except where otherwise established; in this case, any refusal to enter them makes registration impossible. Personal data can be viewed and modified at any time. Only people who have reached the age of 18 (or 21 in some countries) can validly purchase goods online on the website www.piscopojewels.it. The data, in whole or in part, will be disclosed to third parties for the performance of functions strictly connected and / or instrumental to the operation of the service, such as the management of the computer system, the control of payments and the shipment of purchased goods. In relation to the above, the Customer gives his consent to the processing and communication of their personal data and to the related processing to the subjects who carry out the activities indicated above for the full and regular performance of the service offered by the Company Piscopo Vincenzo snc

 

Art. 7 Advertising messages

The Company Piscopo Vincenzo snc will not send, by e-mail, commercial and promotional information without the prior and express consent of the Customer or any other interested party, in compliance with the legislation on the protection of individuals with regard to the processing of their personal data as outlined by Legislative Decree no. 196 of 30 June 2003 and subsequent amendments and by the General Data Protection Regulation no. 2016/679 (in initials GDPR), in compliance with the legislation on electronic commerce.

 

Art. 8 Right of withdrawal

For purchases made through the Site, if the Customer qualifies as a "consumer" pursuant to the Consumer Code approved by Legislative Decree 6 September 2005 n. 206, has the right of withdrawal on the basis of the provisions of the law, within 14 days from the delivery of the products, by contacting the Seller for the return procedures.

 

The goods must be returned, by and at the expense of the Customer, within 14 days from the date on which the Customer himself communicated to the Seller his decision to withdraw.

 

If the products have been used, modified and customized, the right of withdrawal does NOT apply and the Seller will inform the Customer by e-mail. In this case, the Customer may ask the Seller, by e-mail, to return the purchased products at his own expense. Otherwise, the Seller reserves the right to withhold both the products and the amount corresponding to the purchase of the products themselves.

 

The Seller will only accept returns of goods in perfect condition, with the attached warranty and in their original packaging, accompanied by the relative purchase invoice or, if missing, by the relative Order acceptance receipt.

 

NB In the event that the returned product has contributed to the achievement of a minimum order for obtaining a gift, with the return of the product the return of the aforementioned gift is also understood and mandatory.

 

Except as provided in the previous provisions, once the return of the products has been obtained, the Seller will refund the amount actually paid by the Customer within 14 days,

 

  PAYMENT WITH CASH ON DELIVERY: reimbursement is made only by bank transfer. In this case, the customer must provide us with your bank details (IBAN and account holder data) by e-mail, when sending the return request.

PAYMENT BY BANK TRANSFER: the refund is made by bank transfer to the account provided by the customer who wants to be refunded, in  in this case, the customer must provide us with your bank details via email (IBAN and account holder data), when sending the return request.

PAYMENT WITH PAYPAL: the cancellation is made directly via PayPal.

 

In any case, the reimbursement of the price paid by the Customer for the purchase of the products DOES NOT include the shipping costs incurred at the time of placing the Order.

 

Art. 9 Resolution

In case of non-fulfillment, even partial, of the obligations by the Customer, the Ditta Ditta Piscopo Vincenzo snc reserves the right to terminate this contract pursuant to and for the purposes of art. 1456 cod. civ. with simple written communication to be sent by e-mail to the e-mail address provided during registration by the Customer. Ditta Piscopo Vincenzo snc also reserves the right to refuse any and all future purchases by the defaulting Customer, also reserving the right to take legal action to protect their rights. In any case, the rights of Ditt remain unaffected

to Piscopo Vincenzo SNC to receive the fees for the services used, in addition to the right to compensation for damage.

 

Art. 10 Force majeure

If a party cannot meet its contractual obligations for reasons of force majeure such as natural phenomena of particular intensity, war events, strikes, epidemics, unforeseen restrictions ordered by the authorities, etc., the fulfillment of the contract or the date for fulfillment of the contract are deferred based on the event that occurred.

 

Art. 11 Limitation of Liability

The Piscopo Vincenzo snn company cannot be held responsible for the loss or damage suffered by the Customer or the recipient, due to delays, slowdowns and interruptions of the e-commerce service, if the delays, slowdowns, interruptions do not depend on one's conduct. o are caused by the malfunctioning of telecommunications services, including those with added value, of the services of energy suppliers and of Internet access services. The Company Piscopo Vincenzo snc cannot be held responsible for the loss or damage suffered by the Customer due to delays, slowdowns and interruptions of the e-commerce service or due to delays in the execution of the purchase order or due to the non-execution of the the same, if the delay, slowdown, interruption and non-fulfillment are caused by an impediment independent of one's will, which could not reasonably have been foreseen and whose consequences could not be avoided or limited, by way of example: delays and / or defaults caused by the express courier, etc.

 

Art. 12 Transfer of rights and duties

Neither party may transfer rights and duties resulting from this agreement to third parties without the prior written approval of the other party.

 

Art. 13 Jurisdiction and competent court

These General Conditions of Sale, the Contract and all legal relationships deriving from it are governed exclusively by Italian law; any related dispute is subject to the exclusive Italian jurisdiction.

 

Except as provided by the Consumer Code, the Court of Torre Annunziata will be exclusively competent for any dispute that may arise in relation to the interpretation, application and / or execution of these clauses.

 

POSSIBLE CLAUSE IN CASE AN ADDITIONAL FLAG IS POSSIBLE

 

Pursuant to and for the purposes of Articles 1341 and 1342 cod. civ. the following articles of the General Conditions of Sale are expressly approved: 4) Orders and Prices; 5) Shipping and delivery; 8) Right of Withdrawal and Returns; 9) Resolution; 10) Force Majeure; 11) Limitations of Liability; 12) Transfer of rights and duties; 13) Jurisdiction and competent court.
